These Terms of Service ("Terms") govern your use of the website located at https://enrichley.io and any related services provided by Enrichley LLC ("Company," "we," "us," or "our").

1. Services Description

Enrichley LLC provides data enrichment and verification services, including but not limited to:

  • Email Verification: Validation and verification of email addresses, including catch-all email detection
  • Data Enrichment: Company and people search services to enrich your contact and business data
  • API Access: Programmatic access to our verification and enrichment services

The specific features available to you depend on your subscription plan.

2. Account Registration

To access our Services, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

3. Subscriptions and Billing

Subscription Plans: We offer monthly subscription plans that include a set number of credits for use with our Services. Details of available plans and pricing are available on our website.

Auto-Renewal: All subscriptions automatically renew at the end of each billing period unless cancelled. You will be charged the then-current subscription rate at each renewal.

Payment Processing: All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on file for all fees associated with your subscription.

Failed Payments: If a payment fails, we will attempt to process the payment again. You will have a 5-day grace period to update your payment information. If payment is not received within this grace period, your subscription will be cancelled and you will lose access to paid features.

Price Changes: We reserve the right to change our subscription prices. Any price changes will be communicated to you in advance and will apply to your next billing cycle.

4. Credits and Usage

Credit Allocation: Each subscription plan includes a monthly allocation of credits. Credits are used to perform email verifications, data enrichment lookups, and other services.

Credit Rollover: Unused credits roll over to the next billing period only while your subscription remains active. Credits do not accumulate indefinitely; rollover is limited to your active subscription period.

Non-Transferable: Credits are non-transferable between accounts and cannot be sold, traded, or exchanged for cash.

Expiration on Cancellation: Upon cancellation of your subscription, all unused credits expire at the end of your current billing period and are forfeited. No credit for unused credits will be provided.

5. Cancellation Policy

How to Cancel: You may cancel your subscription at any time through your account's billing portal or by contacting us at support@enrichley.io.

Effect of Cancellation: Cancellation takes effect immediately, but you will retain access to paid features until the end of your current billing period.

No Partial Refunds: We do not provide refunds for partial billing periods. When you cancel, you will not be charged for subsequent billing periods, but no refund will be issued for the remaining time in your current period.

Unused Credits: Any unused credits are forfeited upon the end of your billing period after cancellation.

6. Refund Policy

Our complete refund policy is available on our Return Policy page. Key points include:

  • 7-Day Window: Refund requests must be made within 7 days of the charge
  • No Credits Used: Full refund available if no credits have been used
  • Credits Used: Prorated refund based on the cost per credit used
  • No Service Credits: We do not issue service credits in lieu of refunds

7. Chargebacks

Contact Us First: If you have a billing dispute or concern, we strongly encourage you to contact us at support@enrichley.io before initiating a chargeback with your bank or credit card company. We are committed to resolving billing issues promptly and fairly.

Chargeback Consequences: Filing a chargeback without first attempting to resolve the issue with us may result in:

  • Immediate account termination: Your account will be immediately suspended and terminated
  • Permanent ban: You will be permanently prohibited from creating new accounts or using our Services
  • Chargeback fees: You will be responsible for any chargeback fees incurred (minimum $25), plus any additional costs associated with the dispute
  • Collection efforts: We reserve the right to pursue collection of any amounts owed, including the original charge, chargeback fees, and collection costs

We maintain detailed records of all transactions and account activity. Fraudulent chargebacks will be contested, and we reserve the right to report fraudulent activity to relevant authorities.

8. Data Accuracy Disclaimer

No Guarantee of Accuracy: While we strive to provide accurate and up-to-date information through our email verification and data enrichment services, we do not guarantee the accuracy, completeness, or reliability of any data provided. Data can become outdated or incorrect due to factors beyond our control.

Use at Your Own Risk: You acknowledge that any decisions made based on data obtained through our Services are made at your own risk. Enrichley LLC is not liable for any damages, losses, or consequences arising from your use of or reliance on the data we provide.

No Professional Advice: Our Services do not constitute professional, legal, financial, or any other type of advice. You should independently verify any information before making important decisions.

9. Limitations of Use

By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

  • Modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website
  • Remove any copyright or other proprietary notations from any materials and software on this website
  • Transfer the materials to another person or "mirror" the materials on any other server

11. Dispute Resolution

Informal Resolution: Before initiating any formal dispute resolution proceeding, you agree to first contact us at support@enrichley.io and attempt to resolve the dispute informally for at least 30 days. Most disputes can be resolved through direct communication.

Binding Arbitration: If we cannot resolve a dispute informally, you and Enrichley LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or your use of the Services, shall be resolved exclusively through final and binding arbitration, rather than in court.

Arbitration Location and Rules: Arbitration shall be conducted in San Diego, California, administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitrator's decision shall be final and binding.

Class Action Waiver: YOU AND ENRICHLEY LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

Exceptions: Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

12. Limitation of Liability

Our website and the materials on our website are provided on an "as is" basis. To the extent permitted by law, Enrichley LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

Liability Cap: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ENRICHLEY LLC'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO ENRICHLEY LLC DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

In no event shall Enrichley LLC or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if Enrichley LLC or an authorized representative has been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, "consequential loss" includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Enrichley LLC has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement, approval or control by Enrichley LLC of the site. Use of any such linked site is at your own risk and we strongly advise you make your own investigations with respect to the suitability of those sites.

14. Right to Terminate

We may suspend or terminate your right to use our website and terminate these Terms immediately upon written notice to you for any breach of these Terms. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Severance

Any term of these Terms which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms is not affected.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Subject to the arbitration provisions above, you irrevocably submit to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.
